COACHING TERMS AND CONDITIONS

These Coaching Terms and Conditions apply to all 1:1 and group coaching services provided by Marie Fox (ABN 20 679 251 189), trading as Crafty Fox By Design (may also be referred to as Marie, I, me or my), based in South Australia. By purchasing a package, booking a session, or joining a program, you agree to the following terms.

1. COACHING OVERVIEW

Crafty Fox By Design offers both 1:1 and group coaching options to support you in your business journey. Coaching may include training, strategy, accountability, and mentoring around design, branding, Canva, productivity, and small business growth.

Unless agreed otherwise, all coaching is delivered online via Zoom or similar platforms.

1.1 Private Coaching

  • 1:1 sessions are booked in advance via my online calendar.
  • You are responsible for booking and using your sessions before the expiry date.
  • Session types may include one-off calls, multi-hour blocks, or VIP Days.

1.2 Group Coaching

  • Group programs or memberships may include live calls, Q&A sessions, and community support.
  • As this is a shared environment, respectful conduct is expected from all members.
  • Participation in group settings is voluntary. Please respect the privacy of others and avoid sharing their stories outside the group.

2. COACHING IS NOT THERAPY OR FINANCIAL ADVICE

I am a small business coach and Canva specialist, not a licensed mental health professional, financial adviser, or legal consultant. While coaching can be transformative, it is not a substitute for professional services in those fields. You should seek appropriate advice for legal, financial, or mental health matters.

3. BOOKINGS AND SCHEDULING

  • You are responsible for booking your coaching sessions.
  • If you cannot find a suitable time, please reach out. I will do my best to accommodate but cannot guarantee specific dates.
  • Unused sessions expire at the end of your package term and will not be carried forward.

3.1 Coaching expiry timelines:

  • One-off sessions: valid for 4 weeks from purchase.
  • Packages (5, 10 or 20 hours): valid for 6 months (26 weeks).
  • VIP Day sessions: valid for the booked date only unless rescheduled in advance.

4. SESSION RECORDING

Sessions may be recorded for your personal use (e.g. to review strategy or advice). These recordings are private and must not be shared, sold, or published without written permission. If you would prefer not to be recorded, please let me know before your session.

5. PAYMENTS & FEES

5.1 Payment is due upfront before coaching begins (unless agreed otherwise).

5.2 Payments are accepted via Stripe, PayPal, and other methods as listed at checkout or on your invoice.

5.3 If you choose a payment plan, missed payments may result in a pause in access until payments are caught up.

5.4 You are still liable for the full package value, even if you do not attend or use all components.

5.5 You agree to pay any dishonour fees or collection costs if payments fail or are unpaid.

6. CANCELLATIONS, RESCHEDULING & REFUNDS

6.1 Cancellations and Missed Sessions

  • You must give at least 24 hours’ notice to reschedule or cancel a 1:1 session.
  • Missed sessions with no notice are considered forfeited and will not be rescheduled or refunded.
  • Group coaching call replays are typically made available where possible, but live attendance is your responsibility.

6.2 Refund Policy

  • Refunds are not offered for change of mind. Coaching requires commitment and follow-through and my time is booked specifically for you.
  • In line with the Australian Consumer Law, you may be entitled to a remedy if a service is not delivered as promised, is faulty, or unfit for purpose.
  • If a refund is approved, it will be processed via your original payment method and may be subject to processing times from PayPal or Stripe.

7. YOUR RESPONSIBILITIES

You agree to:

  • Take responsibility for scheduling your sessions
  • Show up on time, ready to engage and participate
  • Take full responsibility for decisions and actions following coaching
  • Seek professional advice where needed in areas outside my expertise

If you are currently under the care of a mental health professional, please consult with them before starting coaching.

8. CONFIDENTIALITY

All personal or business information shared during coaching is confidential and will not be shared with others unless required by law. Likewise, in group coaching programs, you agree to maintain the privacy of fellow participants and not share their stories, screenshots, or content outside the group.

9. USE OF AI & DIGITAL TOOLS

Some tools or suggestions during coaching may be AI-assisted. These are offered to support your learning and productivity but are not a replacement for personalised, professional advice. Please always apply your judgement and seek expert input when necessary.

10. INTELLECTUAL PROPERTY

All materials, templates, systems, and strategies shared during coaching are the intellectual property of Crafty Fox By Design. You are welcome to use them for your personal business but may not share, reproduce, resell or use them to create your own courses or coaching products without permission.

11. LIMITATION OF LIABILITY

11.1 To the extent permitted by law, I am not liable for any direct or indirect loss or damage that may result from coaching. Results are not guaranteed, and outcomes depend on your unique circumstances, actions and engagement.

11.2 My total liability is limited to either re-delivering the coaching service or issuing a refund equal to the amount paid.

11.3 You agree to indemnify me and hold me harmless against loss or damages suffered by you or any other person arising from your breach of these terms and conditions.

12. DISCLAIMER

The coaching services, programs, advice, and materials provided by Crafty Fox By Design are intended to support, guide, and empower you in your business journey. However:

  • Results vary from person to person depending on your unique circumstances, actions, and level of implementation.
  • Coaching is not therapy or counselling. I do not diagnose, treat or offer mental health advice.
  • Coaching is also not a substitute for professional legal, financial, accounting, medical, or mental health advice. You are encouraged to seek qualified advice where appropriate.
  • You are fully responsible for your decisions, actions, and results based on the guidance received during coaching sessions or through related content.
  • All examples, stories, or case studies shared during coaching are for illustration only and do not guarantee similar outcomes.

By engaging in coaching, you acknowledge that any outcomes or changes in your business are ultimately up to you.

13. THIRD-PARTY SERVICES

Any external products, services or providers recommended during coaching are offered in good faith. You are responsible for doing your own research. I am not liable for your use of any third-party service.

14. TERMINATION

14.1 Coaching ends at the conclusion of your package or agreed term.
14.2 I may terminate this agreement with 7 days’ written notice if I’m unable to deliver the service. A refund will be provided for any unused portion of the package (at my discretion).

15. GENERAL

15.1 Governing Law: This agreement is governed by the laws of South Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of South Australia.

15.2 Assignment: Your coaching package is for you only and cannot be transferred.

15.3 Entire Agreement: These terms form the full agreement between us.

15.4 Severability: If any clause is found to be unenforceable, the rest remains in effect.
